1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the website located at quinnwildlife.org (the "Site") operated by Quinn Wildlife Sanctuary ("QWS," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.

2. About Us

Quinn Wildlife Sanctuary is an Alabama-based nonprofit organization dedicated to rescuing, rehabilitating, and releasing injured and orphaned native wildlife, with a focus on raptors. We engage with the public through our website, volunteer programs, donations, and educational outreach.

3. Description of Services

The Site provides information about our organization, programs, conservation work, and ways to get involved. Through the Site, visitors may:

  • Learn about wildlife conservation, raptors, and our work
  • Sign up to volunteer through our online forms
  • Opt in to receive email and SMS communications about volunteer opportunities
  • Access links to third-party platforms for merchandise purchases and donations
  • Contact us with questions or inquiries

The Site does not process payments directly. Merchandise sales are handled by Bonfire, and donations are processed through separate third-party platforms.

4. Communications and SMS Opt-In

By signing up as a volunteer and providing your email address and phone number, you may receive communications from QWS, including:

  • Email communications: volunteer coordination, role-specific call-outs, training announcements, and general organizational updates.
  • SMS messages (only with your express consent): urgent volunteer call-outs for time-sensitive needs, such as animal transport.

You may opt out of email communications at any time by clicking the unsubscribe link in any email. You may opt out of SMS messages at any time by replying "STOP" to any text message. Message and data rates may apply.

5. Acceptable Use

You agree not to use the Site to:

  • Violate any applicable local, state, federal, or international law
  • Advertise or offer to sell goods or services
  • Sell, transfer, or share access to any account or profile
  • Submit false, misleading, or fraudulent information through any form
  • Interfere with or disrupt the Site or servers
  • Attempt to gain unauthorized access to any portion of the Site or its systems
  • Use any automated means (such as bots or scrapers) to access the Site without our prior written consent
  • Harass, abuse, or harm another person through use of the Site

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, photographs, and the Quinn Wildlife Sanctuary name and brand, is the property of Quinn Wildlife Sanctuary or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written permission.

7. Third-Party Links and Services

The Site may contain links to third-party websites and services (including but not limited to Bonfire for merchandise, donation processors, and social media platforms). We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your interactions with third-party services are governed by their own terms and policies.

8. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Educational content on the Site is provided for general informational purposes and should not be relied upon as a substitute for professional advice regarding wildlife care, veterinary care, or other matters. If you encounter injured or orphaned wildlife, please contact a licensed wildlife rehabilitator or the appropriate state wildlife authority.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Quinn Wildlife Sanctuary, its directors, officers, employees, volunteers, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site.

Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the Site shall not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Quinn Wildlife Sanctuary and its directors, officers, employees, volunteers, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of another party.

11. Dispute Resolution

Informal Negotiation. Before initiating any formal dispute resolution, you agree to first contact us at alexis.q@quinnwildlife.org and attempt to resolve any dispute informally. The parties agree to engage in good-faith informal negotiations for a period of at least thirty (30) days before initiating arbitration.

Binding Arbitration. If informal negotiations do not resolve the dispute, any controversy or claim arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration conducted in the State of Alabama. The arbitration shall be administered in accordance with the rules of a recognized arbitration provider, and judgment on the arbitration award may be entered in any court having jurisdiction.

Arbitration Fees. Quinn Wildlife Sanctuary agrees to pay any arbitration filing fees deemed excessive to ensure access to the arbitration process.

Litigation Venue. Notwithstanding the above, any disputes that proceed to court rather than arbitration shall be brought exclusively in the state or federal courts located in the State of Alabama, and you consent to the personal jurisdiction of such courts.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles.

13. Termination

We reserve the right to terminate or suspend your access to the Site at any time, without notice, for any reason, including but not limited to a breach of these Terms.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall continue in full force and effect.
